In addition to his regulatory and white-collar practices, Mr. Bourelly has represented Fortune 500 companies in a variety of civil matters, including matters alleging civil fraud, breach of contract and intellectual property theft.  

 

Before helping to launch Bourelly, George and Brodey PLLC, Mr. Bourelly served as Washington D.C. Litigation Chair and White-Collar practice leader for an AmLaw 100 law firm.  Before that, he was a fraud and public corruption federal prosecutor in Washington D.C. where he prosecuted more than sixty criminal jury and bench trials and argued eight appellate matters in both state and federal courts.  Prior to his work in the U.S. Attorney's Office, Mr. Bourelly was senior counsel in the Securities and Exchange Commission's Division of Enforcement, where he was responsible for cases involving insider trading, market manipulation and accounting fraud.

REPRESENTATIVE MATTERS​

DOJ Investigations

  • Represented Lewis “Scooter” Libby, former Chief of Staff to Vice-President Richard B. Cheney, in connection with allegations of perjury and obstruction of justice in a Special Counsel investigation into the disclosure of the identity of a former CIA agent.

  • Represented Lord Conrad M. Black in connection with SEC and DOJ investigations and prosecutions alleging securities fraud and misappropriation of the corporate assets of Hollinger International.

  • Defended majority shareholder in multi-year FCPA and False Claims Act investigation into defense contractor’s fuel delivery operations in Iraq and Afghanistan.

  • Obtained a non-prosecution resolution on behalf of the former CFO of publicly-held collectibles/entertainment enterprise in connection with SEC and DOJ investigations into shareholder fraud and corporate looting. 

  • Obtained favorable resolution for multinational home and healthcare products company in connection with DOJ Clean Water Act investigation stemming from an alleged illegal discharge from a company-owned manufacturing facility.  

  • Represented executive of freight forwarding company in DOJ price-fixing and conspiracy investigation of forwarders in Japan and China associated with the Panalpina FCPA settlement.  Successfully convinced DOJ to abstain from charging client.

  • Represented Senior Sales Executive of Japanese automotive lighting manufacturer in connection with the DOJ Antitrust Division’s sweeping investigations into collusive pricing activities in the automotive industry. Matter resolved with no action against client.

  • Represented the General Counsel of a major defense contractor in connection with multi-agency investigation into possible International Traffic in Arms Regulation violations relating to post-9/11 transactions in Iraq.  DOJ dismissed indictment against client.

  • Represented regional head of sales for major pharmaceutical company in connection with DOJ/Antitrust Division investigation of suspected “price signaling” in the market for blood bank reagents.  Investigation concluded with no charges against client.

 

SEC/CFTC/FINRA Investigations

  • Represented global Fortune 500 technology company in investigation of payment irregularities (including bribes, kickbacks and financial misappropriation) in Latin America and Europe; advised company on extensive remediation measures.

  • Conducted international internal investigation on behalf of a multinational I.T. consulting corporation and represented the company and various top executives in connection with SEC investigation regarding allegations of accounting fraud in the company’s U.K. and Australian operations.

  • Represented pipeline construction company in connection with an SEC investigation into company accounting restatements. Persuaded SEC staff to close investigation without recommending enforcement action.

  • Represented CFO and CAO of regional bank in connection with SEC investigation into allegedly false valuations of the bank’s commercial real estate loan portfolio.  Convinced SEC staff to issue no-action letters for both clients.

  • Represented major bank traders in connection with CFTC investigation into market manipulation in the interest rate swaps market. No charges brought against clients.

  • Defended Wall Street bank currency trader in FINRA investigation into use of unapproved communications channels and intentional destruction of documentary evidence.  Client received “cautionary warning” but no other sanction.

  • Defended major energy company against SEC allegations of Regulation S-K perquisite disclosure violations.  Convinced SEC staff not to recommend enforcement action.
